Terms of Service

1.1 Overview.

These terms become effective when you register for the service as a film creator. All submission services are provided and operated by Chengdu Guangyingyiwo Cultural Communication Co., Ltd. (the owner of https://www.google.com/search?q=Toujiang.com, hereinafter referred to as "Toujiang"). Your unmodified acceptance of all terms and conditions contained herein, as well as all other operating rules and policies that "Toujiang" may publish on the website from time to time, is a prerequisite for "Toujiang" to provide the service. If you do not agree to any such terms, conditions, rules, or policies, please do not use or access the service.

1.2 Modification of Terms.

"Toujiang" reserves the right to modify or replace these terms or any terms or conditions at its sole discretion at any time. You may check these Terms of Service periodically for changes. Your continued use of the service following the posting of any changes to these Terms of Service constitutes your acceptance of those changes. Otherwise, please stop accessing and using the services provided by "Toujiang".

1.3 Language Versions.

For your convenience, we may translate these Terms of Service, our Privacy Policy, or any other operating rules or policies published on the website from time to time into other languages. The Chinese versions of these documents are our primary versions. If there is any conflict between the Chinese version and a translated version, the Chinese version shall prevail.

2. Brief Description of "Toujiang".

"Toujiang" provides a convenient way for film festival and exhibition organizers to collect works and payments. Payments are made through third-party payment services, such as WeChat Pay.

3. Transaction Method for Your Use of Service.

Using the service implies your agreement that "Toujiang" acts as an agent for the film festival. When collecting submission fees, ticket fees, or merchandise fees, "Toujiang" will process transactions and collect fees on behalf of the film festival.

4. Payments.

4.1 Third-Party Payment Terms.

When using third-party payments (such as WeChat Pay), film festivals and film creators conduct applicable currency payment transactions through third-party services and are subject to the applicable terms of use governing such third-party services.

4.2 Refunds.

Film festivals are responsible for communicating their refund policies to filmmakers and issuing refunds to film creators through "Toujiang" or other means. If a film creator wishes to request a refund, the film creator must apply to the film festival for the refund. All disputes regarding refunds are the responsibility of the film festival and the film creator. "Toujiang" will not be liable in any way for refunds, refund errors, or insufficient refunds related to the service. If you are a film creator and wish to request a refund related to an event listed on "Toujiang", you should first contact the respective film festival directly.

5. Your Obligations in Registering for the Service.

To become a registered user of the service, whether as a film creator or other non-film festival user, you agree to: (a) provide true, accurate, current, and complete information about yourself as prompted by the website's registration form ("Registration Data"); and (b) maintain and promptly update the Registration Data to keep it true, accurate, current, and complete. If you provide any information that is untrue, inaccurate, not current, or incomplete, or if "Toujiang" has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, "Toujiang" has the right to suspend or terminate all of your accounts and refuse any and all current or future use of the service (or any part thereof).

6. Your Account, Password, and Security.

As part of the website registration process, you will create a password and account. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your account, including but not limited to all actions of sub-users registered under your account. "Toujiang" cannot and will not be liable for any loss, damage, or other liability arising from your failure to comply with this section or from unauthorized access to or use of your account. In the event of any dispute between two or more parties regarding account ownership, you agree that "Toujiang" shall act as the sole arbitrator of such dispute at its sole discretion, and you agree that "Toujiang"'s decision (which may include termination or suspension of any disputed account) shall be final and binding on all parties.

7. Protection and Rules for Uploaded Content.

7.1 Website Content.

You agree that all materials, including but not limited to information, data, software, text, design elements, graphics, images, and other content (collectively "Content"), contained in or provided through the service, or otherwise made available by "Toujiang" (collectively "Site Content"), are protected by copyright, trademark, service marks, trade secrets, or other intellectual property rights and other proprietary rights and laws. Unless explicitly authorized in writing by "Toujiang" or related to the intended function of your use of the service, you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit any Site Content, create derivative works from any Site Content, or post any Site Content on any other website or networked computer environment for any purpose. When using the service, you will not engage in or use any data crawlers, robots, scraping, or similar data collection or extraction methods. Strictly prohibited is the use of the service or service content in any manner not specifically authorized by this agreement. Strictly prohibited is the copying, reproduction, or distribution of any Site Content for any other purpose without the prior express written permission of "Toujiang".

7.2 Requirements for Your Submitted Content.

Your use of the "Toujiang" website and service does not grant us or any third party any ownership rights to your intellectual property. You retain the copyright and all ownership rights to your work. You represent and warrant that you possess all rights, powers, and authority necessary to grant the foregoing licenses, and that all of your content (i) does not infringe, violate, misappropriate, or otherwise conflict with the rights of any third party, and (ii) complies with all applicable laws and regulations (foreign and domestic).

8. Code of Conduct on "Toujiang".

8.1 Content Restrictions.

Whether you use the service as a film creator or other non-film festival person, you understand that you are responsible for all content you provide or otherwise make available to Toujiang servers. You may not provide content that is: illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;

You may not harm minors in any way;

You may not post any content that promotes gambling, gaming, lotteries, raffles, sweepstakes, or any other activity featuring the awarding of prizes;

You may not impersonate any person or entity, including but not limited to a "Toujiang" representative or forum leader, or falsely state or otherwise misrepresent your affiliation with a person or group.

8.2 "Toujiang"'s Right to Moderate Content.

Whether you use the service as a film creator or other non-film festival person, you acknowledge that "Toujiang" will not pre-screen any content provided by you or any third party related to the service. However, "Toujiang" and its designees have the right (but not the obligation) to, at their sole discretion: (i) monitor, alter, edit, or remove any content uploaded by you in whole or in part; and/or (ii) revoke and terminate your right to use the service at any time for any reason or for no reason. You acknowledge and agree that "Toujiang" may choose not to display content uploaded by you and may also disclose your content for any reason, including but not limited to legal requirements or a good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce these Terms of Service; (c) respond to claims that any of your content violates the rights of third parties; (d) protect the rights, property, or personal safety of "Toujiang", its users, and/or the public.

9. International Use Protection.

Considering the global nature of the Internet, you agree to comply with locally enforced rules regarding online conduct.

10. Modification or Suspension of Your Service.

"Toujiang" reserves the right to temporarily or permanently modify, suspend, or terminate the service (or any part thereof) at any time for any reason or no reason, with or without notice. You agree that "Toujiang" shall not be liable to you or any third party for any modification, suspension, or termination of the service.

11. Termination of Terms of Service.

"Toujiang" may decide at any time to terminate your password, account (or any part thereof), or your right to use the service, and remove and discard any and all of your content within the service. You agree that termination of your right to use the service may be effected without prior notice, and you acknowledge and agree that "Toujiang" may immediately deactivate or delete your account and all related content and files associated with your account and/or bar further access to such files or the service. Furthermore, you agree that "Toujiang" shall not be liable to you or any third party for any termination of your right to use or otherwise access the service.

12. Link Disclaimer.

"Toujiang" web pages and other carriers may provide links to other Internet websites or resources. Because "Toujiang" has no control over such websites and resources, you acknowledge and agree that "Toujiang" is not responsible for the availability of such websites or resources, and does not endorse and is not responsible for any content, advertising, products, services, or other materials on or available from such websites or resources.

13. Privacy Protection Agreement.

All information provided by you or collected by "Toujiang" in connection with the service is governed by the "Toujiang" Privacy Policy (see "Toujiang" Privacy Policy below). "Toujiang" strongly recommends that you read the Privacy Policy carefully. Additionally, any information you submit or provide to the server may be publicly accessible. You should be careful to protect private information or information that is important to you. "Toujiang" is not responsible for protecting any such information, nor is it responsible for protecting the privacy of emails or other information transmitted via the Internet or any other network you may use. Please be aware that if you decide to disclose personally identifiable information on the service, that information may become public. "Toujiang" has no control over and is not responsible for the actions of you or any other user of the service (whether a film festival, filmmaker, other non-film festival user, or otherwise).

15. Trademark Usage Guidelines.

It is prohibited to use any "Toujiang" trademark as any link redirecting to your website. All goodwill generated from the use of any "Toujiang" trademark shall inure to the benefit of "Toujiang".

16. Choice of Dispute Resolution.

These Terms of Service are protected by Chinese law. In the event of disputes or controversies, they shall be resolved in Chengdu, Sichuan.


Organizer Terms of Service

Film Festival Organizer Terms of Service

I. [Acceptance of Terms]

1.1 General Provisions

The following terms and conditions (hereinafter referred to as "these Terms of Service" or "TOS") apply to all usage behaviors by you as a Film Festival Organizer (defined below, hereinafter referred to as "Film Festival" or "You") regarding:

(a) The Toujiang website and its related domains (including all web pages, subdomains, and components therein, hereinafter referred to as the "Website");

(b) All related services provided through the Website or provided by Toujiang for your event;

(c) All related software (defined below).

(Collectively referred to as the "Service").

The aforementioned services are owned and operated by Toujiang.

Toujiang provides services to you on the condition that you unconditionally accept these terms and other operating rules, policies, and processes published by Toujiang on the website from time to time.

Once you use or access any part of the service, you are deemed to have read, understood, and agreed to be bound by these Terms of Service and related rules.

If you do not agree to these terms or any related rules, please do not use or access this service.

1.2 Modification of Terms

Toujiang has the right to modify or replace any content of these Terms of Service at its sole discretion at any time.

You are responsible for regularly reviewing updates to these Terms of Service.

Continued use of the service after the terms are updated is deemed as your acceptance of the modified terms.

If you do not agree to the modified terms, your sole remedy is to stop accessing, browsing, or using the relevant services.

1.3 Language Versions

For ease of use, Toujiang may translate these Terms of Service, Privacy Policy, or other operating rules into other language versions.

The Chinese version is the formal version with legal effect.

If there is any inconsistency between the Chinese version and any translated version, the Chinese version shall prevail.

II. [Toujiang Service Description]

Toujiang provides a convenient platform for registered film festivals, events, or competition organizers (hereinafter referred to as "Film Festivals" or "You") to:

  • Solicit works or creative content from submitters (hereinafter referred to as "Creators").

Creators can submit works to Film Festivals through the platform.

All payment activities are completed through third-party payment services, such as Alipay/PayPal (collectively "Third-Party Payment Methods"), or through the payment processing system provided by Toujiang (hereinafter referred to as the "Payment Gateway").

These Terms of Service apply to your use of the service as a Film Festival Organizer.

To view the terms of service applicable to Creators or other non-organizer users, please refer to the corresponding pages on the Toujiang website.

III. [Your Use of the Service]

3.1 Scope of Service Use

Toujiang grants you a non-exclusive, non-transferable, non-sublicensable limited right of use, solely for the following purposes:

  • Creating film festival or event pages

  • Promoting, managing, tracking, and soliciting works

  • Collecting submission fees

The aforementioned use must simultaneously meet the following conditions:

(i) Compliance with the stipulations of these Terms of Service;

(ii) Compliance with all applicable laws and regulations (including local and international laws).

Except for the explicit authorization above, you may not yourself, or allow others to, directly or indirectly engage in the following acts:

  1. Modify, copy, or create derivative works based on the service or website content;
  2. Reverse engineer, decompile, disassemble the service, or attempt to obtain source code (except where restrictions are prohibited by law);
  3. Rent, resell, distribute the service, or use the service for timesharing, acting as an operating agent, or other commercial purposes (except for soliciting works and collecting fees through the platform in accordance with these terms);
  4. Remove or modify any rights notices or identifiers in the service or website content;
  5. Engage in any behavior that interferes with or disrupts the normal operation of the service.

3.2 Software Use

If you are permitted to download or use software related to the service, Toujiang grants you a revocable, non-exclusive, non-transferable, non-sublicensable license, limited to your internal use during the use of the service, and strictly subject to these Terms of Service and relevant instructions provided by Toujiang.

The term "Software" in these terms includes but is not limited to all website software, systems, and mobile applications provided by Toujiang.

You bear the risks arising from downloading or using the software yourself, and you are responsible for ensuring that the use of the software complies with all applicable laws and regulations and relevant regulations of credit card institutions.

IV. [Payment Terms]

4.1 Third-Party Payment Relationships

When you use third-party payment methods (such as Alipay/WeChat/PayPal), fund transactions between the Film Festival Organizer and Creators will be completed directly through the third-party payment service and subject to the terms of the third-party payment service itself.

Toujiang is not a party to the transaction and participates only as a provider of technical services and payment channels.

4.2 Credit Card and Payment Processing

(a) Payment Gateway and Payment Process

Payments can be processed directly through the Toujiang platform or completed through third-party payment methods (FPM).

Toujiang, acting as the agent of the Film Festival, collects all submission fees from submitters on behalf of the Film Festival. Toujiang will deduct applicable platform service fees (as agency service commissions payable by the Film Festival to Toujiang) from the collected funds, and pay the balance after deduction of relevant fees to the Film Festival within 7 working days after the Film Festival applies for withdrawal.

Notwithstanding the foregoing, Toujiang reserves the following rights:

  • To suspend or withhold funds at any time when deemed necessary to handle refunds, disputed transactions, chargebacks, customer complaints, fraud allegations, or other abnormal situations;

  • To withhold relevant funds according to law under other provisions of these Terms of Service.

The Film Festival acknowledges and agrees that its final receivable amount is the net amount after deducting all platform service fees, refund amounts, disputed funds, chargeback amounts, and other deductions arising from complaints, fraud allegations, or event-related issues.

Unless otherwise stated, all sales, fees, and funds are settled in RMB or other currencies accepted by Toujiang.

If the Film Festival chooses to set submission fees in a foreign currency accepted by Toujiang, Toujiang will collect and settle in that currency.

(b) Refund Policy

(i) The Film Festival is responsible for clearly explaining its refund policy to submitters and processing refunds to submitters through the platform or offline methods.

The Film Festival shall ensure that its refund policy is consistent with these Terms of Service. All communications or disputes related to refunds are matters between the Film Festival and the submitter. Toujiang assumes no responsibility for refunds, refund errors, or non-refunds, and the Film Festival agrees to fully indemnify and hold harmless Toujiang and its affiliates regarding this.

(ii) Notwithstanding the foregoing, the Film Festival acknowledges and agrees that Toujiang has the right to force refunds for some or all submissions at any time, for any reason or no reason, including but not limited to the following situations:

  • Toujiang receives complaints from a large number of submitters (whether it constitutes a "large number" is determined by Toujiang at its sole discretion);

  • Toujiang believes that the Film Festival is involved in fraud or misrepresentation.

(c) Platform Service Fees

Registering an account, creating an event page, and accessing the service itself are free.

However, Toujiang will charge service fees in the following circumstances:

  • Accepting paid submissions

Relevant fee standards may vary based on individual agreements between Toujiang and specific Film Festivals.

Toujiang reserves the right to adjust fee standards at its sole discretion at any time and will notify the relevant Film Festivals via email.

V. [Your Registration Obligations]

By registering and using this service as a Film Festival user, you agree to:

(a) Provide true, accurate, current, and complete personal and institutional information (hereinafter referred to as "Registration Information") as prompted by the website registration page;

(b) Continuously maintain and promptly update the Registration Information to ensure it remains true, accurate, current, and complete.

If the information you provide is false, inaccurate, not updated in time, or incomplete, or if Toujiang has reasonable grounds to suspect the existence of the above circumstances, Toujiang has the right to suspend or terminate all accounts under your name and refuse any current or future use of the service (or any part thereof) by you.

Toujiang attaches great importance to the safety and privacy of all users (especially minors). To comply with the terms of use of third-party payment service providers or other third-party service providers, you must be at least 18 years old to register an account.

VI. [Account, Password, and Security]

During the registration process, you need to set up an account and password. You are fully responsible for the confidentiality of the account and password and are responsible for all behaviors occurring through your account, including but not limited to the behaviors of sub-accounts or sub-users registered under your account.

You agree to:

(a) Immediately notify Toujiang upon discovering any unauthorized use of the account or password, or any security breach;

(b) Properly log out of the account after each use.

Toujiang shall not be liable for any loss, damage, or liability caused by your failure to comply with this clause or by unauthorized access to or use of your account.

If a dispute arises regarding account ownership, you agree that Toujiang shall serve as the sole adjudicator to judge and make a decision at its own discretion, and its decision (including but not limited to suspending or terminating the relevant account) shall be finally binding on all parties.

VII. [Content]

7.1 Platform Content

You acknowledge and agree that all content provided or displayed by Toujiang through the service, including but not limited to information, data, software, text, design elements, graphics, pictures, and other materials (collectively "Content"), is protected by copyright, trademark, trade secret, or other intellectual property rights and relevant laws.

Without the express written authorization of Toujiang, or beyond the reasonable scope of use allowed by the service functions themselves, you may not sell, license, rent, modify, disseminate, copy, reproduce, publicly display, edit, adapt, or create derivative works of the Platform Content, nor may you publish it to other websites or network environments.

You may not collect platform data through data scraping, crawlers, automated scripts, etc. Any unauthorized use is strictly prohibited. Rights not expressly granted are reserved by Toujiang.

7.2 Content Provided by You

As a Film Festival Organizer, you acknowledge and agree that: if you submit, publish, or provide any content to the platform (hereinafter referred to as "Your Content"), you grant Toujiang a worldwide, perpetual, irrevocable, royalty-free, non-exclusive license to use, including but not limited to using, copying, modifying, distributing, translating, publishing, and displaying such content to submitters and the public.

Your use of Toujiang does not constitute any transfer of your intellectual property rights.

You represent and warrant that:

  1. You possess all necessary rights, authorizations, and qualifications to grant the aforementioned license;
  2. Your content does not infringe the rights of any third party and complies with all applicable laws and regulations;
  3. The information you provide is true and accurate.

Toujiang has the right to remove content that does not comply with these terms at any time at its sole discretion. Furthermore, you agree that Toujiang may use your Film Festival name and logo on the platform and in marketing materials to display your identity as an existing or past cooperative client.

VIII. [Code of Conduct]

8.1 Prohibited Behaviors

You acknowledge and agree not to upload, publish, or disseminate the following content or engage in the following behaviors through the service, including but not limited to:

  • Any illegal, harmful, threatening, harassing, defamatory, obscene, privacy-invading, or objectionable content;

  • Behavior that harms minors;

  • Non-compliant forms of gambling, lotteries, or betting activities;

  • Impersonating Toujiang or other individuals/institutions;

  • Forging information sources;

  • Publishing content you do not have the right to disclose;

  • Infringing any third-party intellectual property rights;

  • Publishing information on goods or services unrelated to the platform's film festival activities;

  • Containing viruses, malicious code, or destructive programs;

  • Interfering with the operation of the platform service or servers;

  • Violating any applicable laws and regulations;

  • Stalking or harassing any individual or institution.

8.2 Platform Disposal Rights

Toujiang has no obligation to review content in advance but has the right to decide at its sole discretion to:

  • Monitor, edit, or delete any content;

  • Suspend or terminate your right to use the service at any time (whether or not with prior notice).

Toujiang may preserve or disclose your content according to law or based on reasonable judgment, including but not limited to cooperating with legal processes, enforcing these terms, responding to infringement allegations, or protecting public safety.

IX. [Special Note on International Use]

Given the global nature of the Internet, you agree to comply with all local laws and regulations regarding online behavior and acceptable content.

Without limiting the foregoing, you agree to comply with all applicable laws and regulations (whether foreign or domestic) related to the export of technical data from China or the country/region where you are located.

Furthermore, this service is subject to China's export control laws. No part of the service may be exported or re-exported to countries where China has imposed an embargo on such goods or services, or provided to nationals or residents of such countries.

By using this service or any part thereof (including downloading any software), you represent and warrant that:

You are not located in any of the aforementioned embargoed countries, nor are you a national or resident of such countries.

X. [Indemnification]

You agree to defend, indemnify, and hold harmless Toujiang and its affiliates, as well as their respective officers, directors, agents, co-branders, partners, and employees, from and against any losses, liabilities, costs, or expenses (including but not limited to reasonable attorney fees and accounting fees) resulting from any claim, demand, lawsuit, arbitration, mediation, investigation, or other proceeding (collectively "Claims") brought by any third party.

Such Claims include those arising from or related to any of the following circumstances, including but not limited to:

  • Content provided by you;

  • Use, participation, or association with the service by you or your affiliates, or their officers, directors, agents, or employees, or infringement of others' rights;

  • Your film festival activities;

  • Your violation of these Terms of Service.

Toujiang will provide notice of such Claims to you where reasonable, but failure or delay by Toujiang in providing such notice shall not affect your indemnification obligations under this section.

Toujiang reserves the right to assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with any reasonable requests for assistance made by Toujiang.

XI. [Service Modification or Suspension]

Toujiang has the right to modify, suspend, or terminate all or part of the service temporarily or permanently at any time, for any reason or no reason, regardless of whether prior notice is given.

Except for service fees involved in refunds to submitters (excluding parts already paid to third-party payment service providers), Toujiang will not refund collected service fees to you for any reason.

You agree that Toujiang shall not be liable to you or any third party for any modification, suspension, or termination of any service.

XII. [Termination]

Toujiang may, at its sole discretion, terminate your password, account (or any part thereof), and/or your right to use the service at any time, for any reason or no reason, including but not limited to the following circumstances:

  • Long-term inactivity;

  • Failure to pay due fees in time;

  • Toujiang believes that you have violated or acted inconsistently with the letter or spirit of these terms.

You agree that Toujiang may terminate your use of the service without prior notice, and may immediately deactivate or delete your account and related content, and prevent you from continuing to access the service.

Toujiang shall not be liable to you or any third party for the aforementioned termination actions.

Clauses in these terms that by their nature should survive termination (including but not limited to limitation of liability, disclaimer clauses, indemnification obligations, and intellectual property-related clauses) shall continue to be effective after the termination of the service.

XIII. [Links]

The service may contain links to other websites or resources. Toujiang has no control over such websites or resources and therefore assumes no responsibility for their availability, content, advertising, products, or services, nor for any loss or damage caused by the use of or reliance on such content.

XIV. [Disclaimer]

The service is provided on an "AS IS" and "AS AVAILABLE" basis.

Toujiang expressly disclaims all warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, title, non-infringement, or fitness for a particular purpose.

Toujiang does not warrant that:

(i) The service will meet your specific needs;

(ii) The service will be uninterrupted, timely, secure, or error-free;

(iii) The results obtained from the use of the service will be accurate or reliable;

(iv) The service itself will meet your expectations;

(v) Any errors in the service will be corrected.

Toujiang assumes no responsibility for any actions taken or not taken by any user, submitter, organizer, or third party before, during, or after the event.

XV. [Liability Waiver and Third-Party Disputes]

Subject to your permission to access and use the service, you understand and agree:

Regarding disputes or controversies arising between you and any third party (including but not limited to other film festivals, film creators, non-film festival entities, etc.), if such disputes relate to the following matters:

  • Use of or access to this service

  • Activities published, submitted, or managed by you through this service

  • Interactions or cooperation between you and other users

Any resulting loss, damage, liability, cost, or expense (whether direct or indirect, known or unknown) shall be borne solely by the relevant responsible party.

To the extent permitted by law, you agree to release Toujiang and its affiliates, officers, employees, agents, and partners from corresponding liabilities that may arise from the aforementioned third-party disputes.

XVI. [Privacy and Information Protection]

Relevant information submitted by you or collected by Toujiang during the use of this service is subject to Toujiang's "Privacy Policy". The Privacy Policy is an integral part of these Terms of Service.

Toujiang recommends that you carefully read and understand the specific content of the Privacy Policy before using the service, especially:

  • For Film Festival users, please note: Toujiang may reasonably use lawfully collected creator information in accordance with the Privacy Policy, including for platform service optimization, event recommendations, or display of relevant promotional information;

  • Information you actively submit or make public may be viewed or obtained by other users on the platform; please be cautious when disclosing personal or sensitive information.

You should properly keep and protect information that is important or private to you.

Toujiang assumes no responsibility for the behavior of users or the consequences thereof, including but not limited to the behavior of film festivals, creators, or other platform users.

XVII. [Notification Methods]

Notices sent to you by Toujiang may be conducted through one of the following methods:

  • Sent to the email address you retained when registering on the platform or during the use of the service;

  • Mailed to the correspondence address in your platform records;

  • Or by publishing announcements, prompts, or links in prominent positions on the platform pages.

XVIII. [Trademarks and Logo Usage]

Trademarks, service marks, and logos used and displayed by Toujiang in this service (hereinafter referred to as "Toujiang Trademarks"), including registered or unregistered trademarks or service marks, are owned by Toujiang.

Except for Toujiang Trademarks, names of other companies, products, or services that may appear in this service may be trademarks or service marks lawfully enjoyed by third parties (hereinafter referred to as "Third-Party Trademarks"). Toujiang Trademarks and Third-Party Trademarks are collectively referred to as "Trademarks".

The provision of this service should not be construed as granting you, by implication, estoppel, or any other means, any license or right to use any Trademark.

Without prior written authorization issued by Toujiang for each specific use, you may not use any trademark related to this service in any way.

You may not use Trademarks to engage in the following acts in any way, including but not limited to:

  • Disparaging or slandering Toujiang, third parties, or their products and services;

  • Misleading the public or damaging the goodwill associated with the trademarks;

  • Other usage methods that Toujiang judges may cause adverse effects on trademark rights or goodwill.

Without Toujiang's prior written consent, it is prohibited to use any trademark in link identifiers linking to or from any website.

All goodwill and related rights and interests generated from the use of Toujiang Trademarks shall belong to Toujiang.

XIX. [Other Terms]

  1. Entire Agreement

These Terms of Service constitute the entire agreement between you and Toujiang regarding your use of the service as a film creator or other film festival user, and supersede any prior or contemporaneous oral or written agreements, communications, or understandings reached by both parties regarding related matters.

When using associated services, third-party content, third-party software, or using the service in a manner not described in these terms, you may also need to comply with other applicable terms or rules.

  1. Governing Law

The conclusion, interpretation, performance, and dispute resolution of these Terms of Service shall be governed by the People's Republic of China.
